The defendant in this lawsuit sold circuit boards that modified the operation of our client’s coin-operated arcade video game. Arcade owners who purchased these boards were able to change the operation of our client’s games without investing in new machines. Because the modified machines had a different user interface and a different user experience, the ability of our client to sell home versions of their game was adversely affected. We conducted a computer-aided survey of players of these games and showed them pictures of the modified games. Over one-third of the respondents identified the modified game as our client’s - a significant factor in a settlement awarding our client all rights to the defendant’s game.
